WARWICK TOWNSHIP BOARD OF SUPERVISORS MINUTES
January 19, 2011

Chairman W. Logan Myers convened the January 19, 2011 meeting of the Board of Supervisors at 7:00 p.m. Present were Supervisors W. Logan Myers, Michael Vigunas, C. David Kramer, Anthony Chivinski and Herbert Flosdorf. In attendance were Township Manager Daniel Zimmerman, Roadmaster Dean Saylor, Chief Edward Tobin, Township Engineer Charles Hess, Greg Eisenbach, and Nelson Peters. Gary P. Klinger from the Lititz Record Express represented the press.

GUEST RECOGNITION: Greg Eisenbach, 338 Bridled Tern, expressed concern over drainage at the rear of his property. He explained that his basement was recently flooded, and he is researching whether the stormwater management facilities that are intended to serve this area were constructed properly, and whether they are functioning as intended. The Code and Zoning Officer explained that Eisenbach’s property is located within the Fair Meadows development in Lititz Borough. He added that this area adjoins the Quail Ridge development in Warwick Township. He noted that the Roadmaster performed an on-site inspection of the area to review the stormwater management facilities that serve Quail Ridge. The Township Manager stated that the Quail Ridge development was constructed during the 1980's. He explained that the swale in this area has been filled in over the years. In addition, yard waste and debris is being deposited by area residents on a privately owned property in Quail Ridge. He noted that natural springs exist in this area. He stated that all of these issues could adversely affect stormwater flow in the area. The Roadmaster explained that the swale in Quail Ridge was constructed at a high point between Warwick Township and Lititz Borough, and was intended to stop stormwater flow into Lititz Borough. Since this area has been filled in, and is partially blocked by the yard waste debris, stormwater is not contained within the swale easement. The Code and Zoning Officer stated that he talked to the property owner where the yard waste is being deposited. He explained that while he was there, two different property owners within the development came to deposit yard waste. The property owner indicated that she previously cleared that area and posted the property; however, someone had removed the signs, and individuals continue to deposit their yard waste at this area. He noted that the affected property owner does not have trees on the property. The property owner said that she can not afford to continue to have the property cleared. The Township Manager explained that staff will work with the property owner to clear the yard waste. He added that he will discuss the issue with representatives of Lititz Borough, and letters will be mailed to property owners within Warwick Township and Lititz Borough advising them that maintenance of the swale on their respective properties is their responsibility. In addition, "No Trespassing" signs will be posted on the affected property. Flosdorf stated that it’s also possible that the basement flooding was a result of an underground spring. The Board is in agreement to authorize the Pubic Works Department to clear the yard waste debris, and to send letters to the affected property owners regarding their responsibility to maintain the swale, and to stop dumping yard debris on private property. Township staff will further evaluate the swale to determine whether additional mitigation will be needed.

LETTER OF COMMENDATION FROM LANCASTER COUNTY CONGRATULATING WARWICK TOWNSHIP FOR BEING RECOGNIZED AS THE CONSERVATIONIST OF THE YEAR BY THE CHESAPEAKE BAY FOUNDATION: The Chairman explained that he and the Township Manager went to the Board of Commissioners office on January 5, 2011 to receive the Letter of Commendation.

APPROVAL OF MINUTES: On a motion by Vigunas, seconded by Kramer, the Board unanimously approved the minutes of the December 1, and December 15, 2010 Board meetings as submitted.

TREASURER'S REPORT: The Board reviewed the Treasurer's Report. On a motion by Vigunas, seconded by Chivinski, the Board voted unanimously to approve the Treasurer's Report as submitted.

PAYMENT OF BILLS: The Board reviewed the list of bills submitted for payment. On a motion by Chivinski, seconded by Kramer, the Board unanimously approved the payment of bills from the General Fund in the amount of $127,762.01.

TOWNSHIP MANAGER'S REPORT: The Township Manager provided a status report on the police feasibility study. He noted that it appears that the draft could be finalized for the Board’s review in February.

The Township Manager provided a status report on the Economic Development Committee. He added that a joint meeting of Lititz Borough, Elizabeth Township, Warwick Township, and Warwick School District will be held at the Warwick Township Municipal Building on Thursday, January 27, 2011 at 6:00 p.m. to discuss economic development opportunities within the region.

The Board unanimously approved the Township Manager’s report.

TAX COLLECTOR'S REPORT: The Board reviewed the December, 2010 Tax Collector's report. On a motion by Chivinski, seconded by Flosdorf, the Board unanimously approved the Tax Collector's December, 2010 report.

PUBLIC WORKS DEPARTMENT REPORT: The Roadmaster presented a report that outlines the activities of the Public Works Department during December, 2010. The Board unanimously approved the Public Works Department Report.

POLICE DEPARTMENT REPORT: Lieutenant Tobin presented a report that outlines the activities of the Police Department during December, 2010. The Board unanimously approved the Police Department Report.

ZONING OFFICER'S REPORT: The Township Manager presented a report prepared by the Code and Zoning Officer that outlines the Zoning/Building permits issued in December, 2010. He outlined the cases heard at the Zoning Hearing Board's December 8, 2010 meeting. The Board unanimously approved the Zoning Officer's Report.

COMMUNICATIONS: The Lititz recCenter expressed appreciation to the Board for their continued support of programs and services provided to the community.

The Board received a letter from Sager Swisher & Company, LLP advising of the upcoming audit of the Township’s finances during 2010.

The Board received a letter from the Lancaster Emergency Management Agency regarding training classes that are being offered on Saturday, February 5, 2011.

CONSIDER REQUEST FROM MERV MILLER BUILDER (A.K.A. C. DAVID & SHIRLEY A. LANDIS) FOR RELEASE OF LETTER OF CREDIT: The Board reviewed the request. The Township Engineer commented that based on the recent completion of the home construction plus the required subsurface storm water facility on Lot 2, and the installation of the subsurface storm water facility on Lot 3, they recommend the Township release $13,273.70 from the current Letter-of-Credit account. The retainage represents their estimate of the costs to complete the remaining site improvements. On a motion by Flosdorf, seconded by Kramer, the Board voted unanimously to release $13,273.70 from the Letter-of-Credit for the C. David & Shirley A. Landis Final Subdivision Plan.

ACKNOWLEDGE RECEIPT OF THE PA COMMONWEALTH TRANSPORTATION INITIATIVE GRANT: The Township Manager explained that the Township was awarded a $393,254.00 grant to extend Highlands Drive north to West 7th Street in Lititz Borough. He explained that this will complete the 10-year effort to provide a local alleviator route to SR 501. He noted that the costs for the roadway extension ($523,367.00) are covered by the grant, and required funds provided by developers for roadway improvements. The Township Manager stated that Township staff will discuss the issue with the affected businesses in Warwick Township to determine whether they wish to provide rear access to their property via Highlands Drive. He noted that these businesses would pay the applicable costs to connect to the roadway.

CONSIDER REQUEST FOR FIRE POLICE FOR A MEDLEY AT MILLPORT CONSERVANCY ON APRIL 2, 2011: The Board reviewed the request. On a motion by Flosdorf, seconded by Kramer, the Board voted unanimously to authorize the use of fire police for the Medley at Millport being sponsored by the Lititz Woman’s Club on Saturday, April 2, 2011.

ACKNOWLEDGE RESIGNATION RECEIVED FROM ANDREW E. SPADE AS ELECTED AUDITOR: The Board reviewed the resignation letter submitted by Andrew E. Spade. On a motion by Kramer, seconded by Chivinski, the Board voted unanimously to accept Andrew E. Spade’s resignation with regrets.

OTHER BUSINESS TO COME BEFORE THE BOARD: Nelson Peters, President of the Pebble Creek Homeowner’s Association, stated that he is working with a disabled resident within the development to provide a designated parking space. He noted that this is not an official handicap parking space, since designated handicap parking is provided elsewhere within the development. In addition, the roadway (Tumbling Run) is designated as "no parking". He explained that he has requested the resident to register with the Police Department to allow them to park in the designated area.

EXECUTIVE SESSION: The Chairman announced that the Board will recess to an Executive Session to discuss personnel issues.

ADJOURNMENT: Upon reconvening the meeting, and with no further business to come before the Board, the meeting was adjourned at 8:03 p.m.
