WARWICK TOWNSHIP ZONING HEARING BOARD MINUTES
December 8, 2010

Vice-Chairman Scott Goldman convened the December 8, 2010 meeting of the Warwick Township Zoning Hearing Board at 6:30 p.m. Present were Board Members Scott Goldman, Mark Will and Brent Schrock. Dane St. Clair and Gary Lefever were absent. Also present were Township Zoning Officer Thomas Zorbaugh, Attorney Melvin Hess, Timothy Burkholder, Dena Lombardo, Sam Lombardo and Jeff Wyant.

MINUTES APPROVAL: On a motion by Will, seconded by Goldman, the Board voted unanimously to approve the minutes of the November 10, 2010 meeting as submitted.

POSTING, PROOF OF PUBLICATION AND NOTICE: The Zoning Officer confirmed the posting, notice and proof of publication of the case to be heard at this evening's hearing.

HEARING PROCEDURES: For the benefit of those present, the Vice-Chairman explained the procedure to be followed for the evening's hearings.

CASE #751, JEFF WYANT - VARIANCE. The Vice-Chairman read the zoning notice for the application received from Jeff Wyant, AIA, 2010 Wallace Street, Philadelphia, PA 19130. The applicant is representing the property owner, Sam Lombardo, 100 Millwyck Road, Lititz, PA. The applicant is seeking a Variance to the Warwick Township Zoning Ordinance under Section 340-13.H, pertaining to building setbacks within the Conservation Zoning District. The applicant would like to add to the existing detached garage and is seeking a 10' relief to a 50' side yard setback at one corner of the proposed addition.

Attorney Melvin Hess, Sam Lombardo and Jeff Wyant were sworn in. Attorney Hess presented the case. Attorney Hess provided the Board members with a packet containing the following applicant’s exhibits: 1) a plot plan showing Lombardo’s property, and surrounding properties; 2) two aerial photographs illustrating the location of Lombardo’s property and the location of Mr. Lloyd High’s farm to the east; 3) four photographs showing the existing detached garage from each side; 4) a plot plan showing the encroachment of 119 square feet within the side yard setback; 5) a packet illustrating the elevations and building plans for the proposed addition to the detached garage; and 6) a letter from Mr. High stating that he has no objections to the proposal. Attorney Hess requested Lombardo to verify whether or not the submitted exhibits accurately depict his property. Lombardo testified that the Exhibits 1-4 accurately depict his property, and that Exhibit 6 is a letter he had written, and Mr. High had signed. Attorney Hess asked Wyant to confirm that Exhibit 5 accurately illustrates the proposed project. Wyant confirmed that the Exhibit 5 as presented accurately illustrates the proposed project. He added that the proposed location for the garage addition would not interfere with the existing wood line, swale and wetland area. Wyant expressed the opinion that the project as submitted is de minimis in nature and is the best location as designed.

On a motion by Goldman, seconded by Schrock, the Board unanimously approved the request for a Variance of Section 340-13.H to allow the proposed addition to be located 40' from the side property line.

CONSIDER EXTENSION OF TIME FOR SHOPPES OF KISSEL VILLAGE: The Board reviewed the request. On a motion by Goldman, seconded by Will, the Board voted to grant an extension of time until January 12, 2011 to start the project.

ADJOURNMENT: With no further business to come before the Board, the meeting was adjourned at 7:00 p.m.
