WARWICK TOWNSHIP ZONING HEARING BOARD MINUTES
March 10, 2010

Acting Chairman Gary Lefever convened the March 10, 2010 meeting of the Warwick Township Zoning Hearing Board at 6:30 p.m. Present were Board Members Gary Lefever, Scott Goldman, Dane St. Clair, Mark Will and Kenneth Kauffman. Also present were Township Zoning Officer Thomas Zorbaugh, Zoning Hearing Solicitor Neil Albert, Michael Kotay and Linda Reed.

MINUTES APPROVAL: The Board voted unanimously to approve the minutes of the December 9, 2009 meeting as submitted.

ELECTION OF OFFICERS FOR 2010: The Acting Chairman opened the nominations for Chairman and Vice-Chairman of the Zoning Hearing Board. On a motion by Goldman, seconded by St. Clair, the Board voted unanimously to close the nominations and re-elected Gary Lefever as Chairman of the Zoning Hearing Board. On a motion by Kauffman, seconded by St. Clair, the Board voted unanimously to close the nominations and re-elected Scott Goldman as Vice-chairman of the Zoning Hearing Board.

Chairman Gary Lefever conducted the remainder of the Zoning Hearing Board meeting.

POSTING, PROOF OF PUBLICATION AND NOTICE: The Township Zoning Officer confirmed the posting, notice and proof of publication of the case to be heard at this evening's hearing.

HEARING PROCEDURES: For the benefit of those present, the Zoning Hearing Solicitor explained the procedure to be followed for the evening's hearing.

CASE #741, VIOLET NOLL. - VARIANCE: The Chairman read the zoning notice for the application from Violet Noll, 1339 Dridge Hill Road, Lititz, PA 17543. The applicant is the owner of the property. The applicant is seeking a Variance to the Warwick Township Zoning Ordinance under Section 340-11.F.(2) maximum lot area and 340-11.G minimum lot frontage, pertaining to a subdivision and lot add-on in the Agricultural Zoning District. The applicant is seeking a Variance of Section 340-11.F.(2) to exceed the maximum lot area on lot 1 from 4.06 acres to 5.86 acres and a Variance of Section 340-11.G to allow the remaining lot 2 to be 14.94 acres without street frontage.

Michael Kotay, representing Diehm & Sons, was sworn in. He explained that he is representing the Noll family at this hearing and Mrs. Noll’s daughter, Linda Reed, is present. Kotay explained the project and used the Smart Board as part of his presentation. Lot 1 (the proposed 5.86 acre tract) is where Mrs. Noll and her daughter lives. The additional acreage is being requested to allow for future septic fields, if needed, and follows the existing farm lane. Lot 2 is a 24 acre tract, and 14.94 acres would continue to be owned by the Noll family. This lot does not have street frontage, but would have over 100' along the existing driveway separating Lots 1 and 2. A 9.08 acre portion would be removed from Lot 2 and added to the lands of Raymond Hurst on Brunnerville Road, resulting in a 29.26 acre tract.

The Chairman inquired whether anyone present wishes to comment on the case. No one present indicated their desire to comment on the case.

On a motion by Lefever, seconded by Goldman, the Board voted unanimously to grant the Variances requested under Section 340-11.F.(2) and 340-11.G, based on the testimony provided this evening.

REQUEST FOR EXTENSION OF TIME FOR SHOPPES AT KISSEL VILLAGE-NORTH EXPANSION: The Board reviewed the request. On a motion by Lefever, seconded by St. Clair, the Board voted unanimously to grant a 3-month extension of time for the Target project.

REQUEST FOR EXTENSION OF TIME FOR RITE-AID PHARMACY-KELLER BROTHERS DODGE: The Board reviewed the request. On a motion by St. Clair, seconded by Lefever, the Board voted unanimously to grant a 12-month extension of time for the Rite-Aid project.

ADJOURNMENT: With no further business to come before the Board, the meeting was adjourned at 7:00 p.m.
