WARWICK TOWNSHIP ZONING HEARING BOARD MINUTES Chairman Randall Wenger convened the December 10, 2003 meeting of the Warwick Township Zoning Hearing Board at 7:00 p.m. Present were Board Members Randall Wenger, Wilmer Burkhart, Scott Goldman, Dane St. Clair, Gary Lefever and Kenneth Kauffman. Also present were Zoning Officer Thomas Zorbaugh, Zoning Hearing Board Solicitor Steven Kraybill, Kevin Hess, John Cardenas, Tracy Cardenas, Brent Good and Court Reporter Rhonda Adams. MINUTES APPROVAL: On a motion by Lefever, seconded by Goldman, the Board unanimously approved the minutes of the November 12, 2003 meeting as submitted. POSTING, PROOF OF PUBLICATION AND NOTICE: The Zoning Officer confirmed the posting, notice and proof of publication of the cases to be heard at this evening's hearing. HEARING PROCEDURES: For the benefit of those present, the Zoning Hearing Solicitor explained the procedure to be followed for the evening's hearings. CASE #618, KEVIN HESS, ELM RIDGE CONSTRUCTION-VARIANCE: The Chairman read the zoning notice for the application received from Kevin Hess, 786 W. Newport Road, Lititz. The applicant is seeking a Variance of Section 204.5 to allow the proposed dwelling unit to be built at 10 Irvin Drive to the old front yard setback of 30' instead of the required 40'. Kevin Hess was sworn in. Hess testified that due to the configuration of the lot because of the hammer head rad configuration, it would be difficult to build a home on this lot meeting the required 40' setback. Hess provided the Board with pictures of the building lot and surrounding homes. Hess also explained that there was a 35' drainage easement in the rear yard causing further difficulties. The Chairman inquired whether or not anyone present would like to comment on this case. Brent Good, 12 Irvin Drive, neighbor to the north was sworn in. Good testified that he was in favor of the location due the road configuration. John Cardenas, 1048 Olde Hickory Road, Lancaster, the potential owner of the home to be built on this lot was sworn in. Cardenas testified that he would like to build a screen porch addition on the rear of the home and would need this relief in order to make the rear yard setbacks, stay out of the existing swale and still have a rear yard. On a motion by Lefever, seconded by Goldman, the Board voted unanimously to grant a Variance under Section 204.5. ADJOURNMENT: With no further business to come before the Board, the meeting was adjourned at 7:35 pm. Respectfully submitted, Thomas L.
