WARWICK TOWNSHIP ZONING HEARING BOARD MINUTES Chairman Randall Wenger convened the April 9, 2003 meeting of the Warwick Township Zoning Hearing Board at 7:00 p.m. Present were Board Members Randall Wenger, Wilmer Burkhart, Scott Goldman, and Kenneth Kauffman. Dane St. Clair and Gary Lefever were absent. Also present were Zoning Officer Thomas Zorbaugh, Zoning Hearing Board Solicitor George Cook, Sue Barry, Kevin Hahn, and Dawn Hahn. MINUTES APPROVAL: On a motion by Goldman, seconded by Kauffman, the Board unanimously approved the minutes of the March 12, 2003 meeting as submitted. POSTING, PROOF OF PUBLICATION AND NOTICE: The Zoning Officer confirmed the posting, notice and proof of publication of the cases to be heard at this evening's hearing. HEARING PROCEDURES: For the benefit of those present, the Zoning Hearing Solicitor explained the procedure to be followed for the evening's hearings. CASE #607, KEVIN & DAWN HAHN-VARIANCE: The Chairman read the zoning notice for the application received from Kevin and Dawn Hahn, 129 Briar Hill Road, Lititz. The applicant is seeking a Variance of Section 204.7.A to allow the proposed detached garage to be between the existing home and the right-of-way. Kevin Hahn was sworn in. Hahn testified that due to the location of the home and the reserve septic field, it would be difficult to place the detached garage in the rear yard. Hahn provided the Board with pictures of the proposed garage, showing the type and style. Hahn testified that the style and color would match the existing home. Hahn also provided pictures of the property showing the drive slope and proposed location of the garage. The Chairman inquired whether or not anyone present would like to comment on this case. Sue Barry, 135 Briar Hill Road, neighbor to the north was sworn in. Barry presented the Board with a letter and pictures expressing her approval of the proposed location of the garage. Wilmer Burkhart asked if the location of the barn could be adjusted to limit the number of trees to be cut. Hahn said that they are willing to adjust the location but will need to stay away from the existing septic system in the front yard. Scott Goldman asked about the height of the structure. The Zoning Officer stated that the height is calculated from the finished floor height to the peak and added that for this property, the measurement would be calculated from the midgrade to the peak. Hahn indicated that he would meet the 20' height limit. On a motion by Goldman, seconded by Burkhart, the Board voted unanimously to grant a Variance under Section 204.7.A with conditions that the height be limited to 20' at midgrade and the structure be adjusted to limit the amount of trees to be cut. ADJOURNMENT: With no further business to come before the Board, the meeting was adjourned at 7:30 pm. Respectfully submitted, Thomas L.
