WARWICK TOWNSHIP ZONING HEARING BOARD MINUTES
March 12, 2003

Chairman Randall Wenger convened the March 12, 2003 meeting of the Warwick Township Zoning Hearing Board at 7:00 p.m. Present were Board Members Randall Wenger, Dane St. Clair, Scott Goldman, and Kenneth Kauffman. Wilmer Burkhart and Gary Lefever were absent. Also present were Zoning Officer Thomas Zorbaugh, Zoning Hearing Board Solicitor David Workman, Ned Pelger, and Jim Wenger.

MINUTES APPROVAL: On a motion by St. Clair, seconded by Goldman, the Board unanimously approved the minutes of the February 12, 2003 meeting as submitted.

POSTING, PROOF OF PUBLICATION AND NOTICE: The Zoning Officer confirmed the posting, notice and proof of publication of the cases to be heard at this evening's hearing.

HEARING PROCEDURES: For the benefit of those present, the Zoning Hearing Solicitor explained the procedure to be followed for the evening's hearings.

CASE #605, NED PELGER-VARIANCE: The Chairman read the zoning notice for the application received from Ned Pelger, Pelger Engineering, 507 W. 28th Division Highway, Lititz, PA 17543. The applicant is representing Buckhill Farms, 1001 Lititz Pike, Lititz, owner of the property located at the intersections of Peters Road and Highlands Drive, Lititz. The applicant is seeking a Variance to the Warwick Township Zoning Ordinance under Section 209.10, pertaining to the permitted building height of 35' in an I-2 Campus Industrial Zone. The applicant would like to build a commercial building and is requesting the roof height to be 40' high.

Ned Pelger was sworn in. Pelger testified that the applicant would like to install a shingled roof with a higher peak and needs relief in order to use shingles

The Chairman inquired whether or not anyone present would like to comment on this case. No one present indicated their desire to comment on the case.

On a motion by Goldman, seconded by St. Clair, the Board voted unanimously to grant a Variance under Section 209.10 as requested.

CASE #606, JIM WENGER-VARIANCE: The Chairman read the zoning notice for the application received from Jim Wenger of Derck & Edson Associates, 33 S. Broad Street, Lititz, PA 17543. The applicant is the consultant for Oakfront Limited Partnership, 508 Front Street, Lititz, owners of the tract located at the intersection of Front Street and N. Oak Street. The applicant is seeking a Variance to the Warwick Township Zoning Ordinance under Section 208.7.A to reduce the front yard setback from 50' to 25' along Front Street, and Section 208.7.D to reduce the rear yard setback from 75' to 35' in an I-1 Industrial Zone. The applicant would like to develop the commercial tract and needs these reliefs to proceed.

Jim Wenger was sworn in. Wenger testified that the majority of the tract is within Lititz Borough and the reliefs being requested will match the Borough’s setbacks.

The Chairman inquired whether or not anyone present would like to comment on this case. No one present indicated their desire to comment on the case.

On a motion by St. Clair, seconded by Goldman, the Board voted unanimously to grant a Variance under Section 208.7.A and to grant a Variance under Section 208.7.D as requested.

EXTENSION OF TIME FOR MICHAEL PALASZ (Case #594): The Zoning Officer explained that the decision for this case was rendered on October 9, 2002, and according to the decision, the applicant would have until April 9, 2003 to obtain the necessary permits to complete the project. The consultant for the applicant has requested an extension of time until October 9, 2003 to obtain the permits in order to finalize the Land Development Plan for the project. On a motion by St. Clair, seconded by Goldman, the Board voted unanimously to grant an extension of time until October 9, 2003 for the Michael Palasz case.

EXTENSION OF TIME FOR ROY ZIMMERMAN (Case #584): The Zoning Officer explained that the decision for this case was rendered on May 8, 2002, and according to the decision, the applicant would have until May 8, 2003 to obtain the necessary permits to complete the project. The consultant for the applicant requested an extension of time until December 8, 2003 in order to finalize the Land Development Plan for the project. On a motion by St. Clair, seconded by Goldman, the Board voted unanimously to grant an extension of time until December 8, 2003 for the Roy Zimmerman case.

ADJOURNMENT: With no further business to come before the Board, the meeting was adjourned at 7:40 p.m.
