WARWICK TOWNSHIP ZONING HEARING BOARD MINUTES
April 10, 2002

Chairman Dane St. Clair convened the April 10, 2002 meeting of the Warwick Township Zoning Hearing Board at 7:00 p.m. Present were Board Members Dane St. Clair, Wilmer Burkhart, Scott Goldman, Gary Lefever, and Randall Wenger. Also present were Zoning Officer Thomas Zorbaugh, Zoning Hearing Board Solicitor David Workman, Philip Hosler, and Darrell Becker.

MINUTES APPROVAL: On a motion by Burkhart, seconded by Goldman, the Board unanimously approved the minutes of the March 13, 2002 meeting as submitted.

POSTING, PROOF OF PUBLICATION AND NOTICE: The Zoning Officer confirmed the posting, notice and proof of publication of the case to be heard at this evening's hearing.

HEARING PROCEDURES: For the benefit of those present, the Zoning Hearing Solicitor explained the procedure to be followed for the evening's hearing.

CASE #580, PHILIP AND SHERRY HOSLER - VARIANCE: The Chairman read the application received from Philip and Sherry Hosler, 1204 Clay Road, Lititz, PA 17543. The applicant is seeking a Variance to the Warwick Township Zoning Ordinance under Section 202.8.B.2 and 202.11, pertaining to a side yard setback in a Rural Estate Zone. The applicant would like to build a detached garage and is requesting relief of the side yard setback from 10' to 5'.

Philip Hosler was sworn in. Hosler testified that he would like to demolish the existing garage on the property and construct a one-story addition containing 2 bedrooms and a bathroom. He noted that the addition would be handicap accessible for his son. He explained that he would like to construct a new detached garage on the opposite side of the home He testified that the new garage would be located on the only flat area available on this side of the property, and to also provide room for a handicap accessible school bus to turn around in the driveway. The Chairman inquired whether or not the applicant considered constructing the garage beside the new addition, adjacent to the existing wall on the property. Hosler testified that they had not considered this location due to the excavation that would be required and due to the slope of the property at this area. The Chairman explained that it appears the applicant may have other options that could reduce th Variance needed for the proposal. Hosler stated that they would rather not excavate the area near the wall and added that although the garage is proposed only 5' from the property line, there are several trees and a grass area 10' between his property and the adjoining farm field. He explained that they would lose some of the driveway area in order to construct the new addition and stated that he does not want to further restrict the turn-around area for the school bus. Burkhart inquired what is the distance between the corner of the driveway where the "T" design begins and the proposed garage. Hosler estimated that the distance is between 40-50'. Burkhart inquired whether or not the garage could be moved 5' farther from the property line in order to meet the 10' setback requirement. Hosler testified that additional asphalt area would be lost if the proposed garage location were moved 5'. He explained that the existing driveway originally ended at the existing wall; however, they extended the driveway 4-5 years ago. The Zoning Officer stated that the existing location of the garage behind the house does not provide sufficient area to drive into the garage, the applicant currently has to turn toward the garage, then back into the driveway and then drive into the garage. He explained that the proposed location of the garage would provide for the applicant to drive directly into the garage. Goldman inquired whether or not the existing trees no the adjoining farm inhibit the adjoining farmer's ability to plow closer to the property line. Hosler stated that the trees are at an elevation slightly higher than the field. Goldman expressed the opinion that whether or not the garage is 5' from the property line or 10' from the property line, it would not alter the area that could be farmed on the adjoining property. The Chairman inquired whether or not anyone present wishes to comment on the case. No one present indicated their desire to comment on the case. On a motion by Goldman, seconded by Lefever, the Board voted 3-2 to grant a Variance of Section 202.8.B.2 and Section 202.11 to allow the proposed garage to be 5' from the property line. St. Clair and Burkhart voted against the motion.

REQUEST FOR AN EXTENSION OF TIME FOR LANCASTER EVANGELICAL FREE CHURCH "WITNESS PARK" (CASE #546:) The Board reviewed the request. On a motion by St. Clair, seconded by Burkhart, the Board unanimously approved an extension of time until June 30, 2002 for Case #546.

REQUEST FOR AN EXTENSION OF TIME FOR SOUTHVIEW LANE "SETBACKS" (CASE #573, ARISITIDES LAZARIDES: The Board reviewed the request. On a motion by Wenger, seconded by St. Clair, the Board unanimously approved a six-month extension of time for Case #573.

ADJOURNMENT: With no further business to come before the Board, the meeting was adjourned at 7:25 p.m.
